im pretty pissed because i wrote all this out already and my computer froze and deleted it all.. arrrg.. this is my problem. im married, my wife and i do not live together WE ARE NOT LEGALLY SEPARATED OR DIVORCED yet. We havent even begun the proceedings.. We got married feb. 09 and I left her may 09. We have no children together thank god! About a month ago my wife vandalized my car to the point it will not run. the damage is $9500. I turned all the evidence I had implicationg my wife into 2 police departments. I had pictures of the car, the estimate for repairs needed, and i even had a recording of a conversation I had with some folks who WITNESSED my wife vandalizing my car and both police departments said that they could do NOTHING about it.. They said it doesnt matter if i had the car before the marriage, it doesnt matter if her names not on the title, we are still married. It is hers as much as it is mine.. Fast forward to last nite. Im not typing out all the crap I typed out earlier as to the circumstances of why I chose to do this but I came to the decision last nite to take HER car. I have the key, Ive always had the key and I took it. Now.. going back to what she did to my car.. The police said they couldnt do anything about it because it is her car too.. So why did the police tell me today that the car is reported stolen and If im caught driving it i will go to jail?? What the hell? Is it possible the police officer told me that in hopes id just bring her the car back and restore the peace? So he doesnt have to be bothered with nonsense like this?? I understand in divorce court me taking her car may look bad but im not worried about that… screw that.. i NEED to know about the legal side of things! If she could get away with destroying my car, how is it that i cannot take her car?? I even have her TITLE! Is there anything I can do with the title like add my name onto it? Whats messed up is I dont have a car, Iost my job because of it.. I hear shes getting a new car and fearing that she would trade the car I took from her last nite in for the new car I made the decision last nite to take it because I know once she buys a new car she will not put it in her name therefore in divorce court this new car shes getting will not even be an issue because it isnt in her name.. So I took the car because I have to survive too! She has 100’s of ways to get around town, to work, hell some idiot is buying her this NEW car… I have NOTHING! Nada, Zip, ziltch.. I need lots of input because I dont plan on giving her this car back until i get my own car or the divorce judge orders me to give it back to her.. Please read this carefully, 2-3 times if u have to because i need help. I just dont understand how she can walk all over me and not get in a lick of trouble and i take her car and all the sudden i can be facing jailtime blah blah blah..

Does he need my signature to sell our marital home if I’m still on the deed?
The divorce was final in October 08 and I let him keep the house. I’ve given him quit claim deeds signed and notorized several times however he refuses to go file them and says he just throws them away. I was never on the mortgage, just on the deed. Well now the house is under contract and I’m assuming set to close (he shares no information with me) and as of county records yesterday I’m STILL on the deed.
So here’s the questions -
1. It’s in the martial settlement agreement that he gets the house but since he never took my name off, am I going to have to go in and sign?
2. If he really didn’t throw away the quit claim deeds I’ve given, can he take that to closing or does he actually have to go file them?
Someone is Thumbs Down happy! So far all of the answers have been knowledgable, conflicting, but knowledgable based on your experience lol

What is up Dwyane Wade?
Heating up: Miami Heat guard Dwyane Wade’s divorce from wife Siohvaughn, his high school sweetheart. In legal papers, she alleges he abandoned his children, committed adultery, and infected her with an unspecified sexually transmitted disease. She wants the names of ”all of his sexual partners” during their six-year marriage.
Dwyane petitioned for the divorce last May in Cook County, Ill. They wed in Chicago on May 18, 2002.
Dwyane’s Windy City attorney, James Pritikin, issued a statement: “These malicious allegations are absolutely false and we look forward to the opportunity to dispute them in court.”
Dwyane turns 27 on Saturday. He and Siohvaughn, 27, have two boys, Zaire, a first-grader who will be 7 next month, and Zion, 1. Siohvaughn moved back to Chicago with the kids last year.
Dwyane’s Heat salary is $14,410,581, according to published reports. He hauls in millions more from major endorsements such as Gatorade and Converse. He has a dozen vehicles, including four Cadillacs, four Mercedes-Benzes and a Maybach, court papers say.
The All-Star has been romantically linked to actress Gabrielle Union, 36, once married to former Jacksonville Jaguar Chris Howard.
From Siohvaughn’s pleading: “Dwyane has dissipated substantial sums of marital property including . . . buying his mother a $2 million church; placing substantial sums of money in an account with another woman; providing numerous friends and family members with unfettered access to accounts with hundreds of thousands of dollars of marital funds from which they made substantial withdrawals . . .”
Meanwhile, she says, he cut her off financially.
Dwyane, named a ”Father of the Year” in 2007 by the National Father’s Day Committee, has gone ”months” without seeing his boys, Siohvaughn says. His ”failure to spend time with them . . . has resulted in the children at times being afraid of him; in fact, Zion . . . does not recognize or know Dwyane.” She wants sole custody, and support.
She also says she has suffered ”grievous physical, emotional and mental injury” from the STD, diagnosed in the fall of ‘07. (The infection is not HIV or a ”killer thing,” sources say.) Dwyane and his ”paramour or paramours” are liable, she alleges.
‘Dwyane must disclose the identity of all of his sexual partners during the parties’ marriage,” says her counter-petition, prepared by attorney Michael J. Berger of Chicago. Siohvaughn has another Chicago lawyer, Dorene Marcus.
Says Pritikin: “It is sad that an obviously angry and bitter woman will go to any lengths to publicly damage Mr. Wade.”
Siohvaughn speaks the truth, Marcus insists. ”A person’s public persona does not necessarily reflect his behavior in private,” Marcus adds. “Mrs. Wade is prepared to prove everything she alleges. And, medical records don’t lie.”
In 2007, the Wades put their six-bedroom Pinecrest home on the market for $8.9 million. Has yet to sell. List price is now $4.599 million.
Dwyane is on the road — again. The Heat play the Rockets in Houston at 8:30 p.m. Saturday.

What are the legal ramifications if you sign your spouse’s signature on the divorce decree?
A family member has been battling with a divorce for some time and decided to sign her ex-spouses signature on the final divorce decree. However, she did not realize that her spouse’s ex-lawyer never filed a withdrawal. Therefore the court requires for the lawyer on record to sign the decree or file a motion for withdrawal. A motion was filed but no parties showed up for the hearing and the motion was thrown out. Since the divorce trial is less than 30 days way, it is seems too late to file the withdrawal. Now all of a sudden the spouse wants to cooperate and is willing to sign. Because of time constraints the former lawyer has agreed to sign the divorce decree too. But my cousin is super nervous now and is afraid that the false signature may be uncovered. So, what happens if they go to court and the judge finds out that the signature on the first decree was forged? This case is taking place in Harris County, Houston, TX. Please be very detailed.
A little add in: Texas does not require for signatures to be notarized.
Also, the spouse and the ex-lawyer have agreed to sign the documents now. But the forged copy is on file with the courts.
Also, Is the spouse’s objection the only way she would get in trouble? What is he doesn’t object or protest the signature?

Hong Kong Marriage?
My younger brother married his filipina sweetheart in Hong Kong last year while vacationing there. After the wedding she returned to Philippines and he to the USA to start immigration paperwork. Now they decide not to remain married. She has second thoughts about leaving her family. No forms have been filed with US Immigration and neither were residents of HK so where does he/she file for divorce? Does the US recognize this marriage since no license has been recorded in the county clerks office?
