What is the correct LEGAL term to apply here: Modification or Clarificationof a prior agreement?

John S. asked:

This would be a Marriage Settlement Agreement (MSA) in the state of Illinois. The original MSA stipulates visitation every other weekend…but does not define whether those would be the odd or even numbered weekends on a: 1) yearly 52 week calendar’ or a 2) monthly calendar (some months having 4 weeks, others having 5) — a FORMULA FOR CONFUSION unless spelled out better in an amending document.

To clarify the arrangement, a modification or amendment of the original MSA is needed so as to specify which weekends are every other weekend.

In a petition to the court of record (County Court), what would the correct name for said plea be called? A Modification, Clarification, Amendment, or something else, as it pertains to the original MSA contract?

Note this would not be something challenged by either party so I’m hoping there would be no need for either party to appear in court. This is a matter of bookkeeping and clarification which we hope to keep to a minimum using self help pro se measures to clean up the loosey-goosey language used in the boilerplate document applied by a sloppy (or purposefully vague) high volume divorce attorney 8 years ago.

Whats the correct term for the petition or motion?

What kind of sick game is my husband playing?

Love My Kids asked:

My husband and I have separated. I have expressed my desire to reconcile, however… and I quote it’s more complicated than that… not sure what in the world that means? He’s abandoned me and my children, left us in the home we lived in and closed our joint accounts, so that I am solely responsible for the mortgage, childcare and all utilities. The house is now in foreclosure, he gripped at me saying that I was living in a house I was not making payments on, when he chose to leave, is not paying child support (YET… I’ve filed, waiting on the SLOW AG) and says he will not make any more payments on the mortgage, although he is very upset that his credit is being damaged (mine too as we are joint owners). Here’s the puzzling thing… He only took with him a basket full of clothes, his pickup truck and car, his two motorcycles, leaving me with only one vehicle that has major brake issues and borderline heat. Everything else, the remainder of his clothes, his furniture he brought into the marriage, all his records and computer, all his tools and other garage items are still in our home. Also, ALL the utilities (electric, water, gas and cable) are still in his name. I’ve tried putting them in my name, but he called and placed a restriction on all the services so that all I could do was make payments. I AM NOT going to file for divorce (it is against my beliefs), he says he has but I work for our County office and he hasn’t done a thing. What kind of sick game do you think he’s playing? I KNOW he is not seeing anyone else. Do you think it could be mid-life crisis? He’s 43…

Do people still get away with bigamy?

I’m not talking about polygamists here. I’m talking about people who leave one spouse but never get legally divorced, then marry another person.

Since county clerks have computerized records now, wouldn’t they be able to look up this information whenever someone files for a marriage license and see that they are already married?

Bonus Question: Can someone get a credit card or utilities in a name that is not legally theirs? Like, if my sister is using her boyfriend’s last name, but *claiming* they are not married (because she’s still married to her ex–the ex says so) can she actually do it on legal agreements like credit cards and utilities?

Did anyone buy or get 2 dogs from San Joaquin County or in Stockton, California: in 2003?

Did anyone buy or get 2 dogs from San Joaquin County or in Stockton, California: in 2003 around February or March? My mom went through a divorce and my dogs were taken to a shelter or a pound with out me ever knowing. I have tried to track them down many times before. But I thought I would try this. I know it was a really long time ago and I am sorry about that. My heart won’t forget them. I love them so much. I have dreams about them all the time. My dog’s names were Meeka and Sonoma and they should have had there name tags on. If the record shows last names it would have been Martin. A big man named Bill took them to the shelter or pound. Meeka was about 85% wolf and she was beautiful. Sonoma was her puppy born on Feb 14, 2001,she is part wolf and chow. She is not as smart as Meeka but Sonoma is very sweet. I don’t know if I can post pictures, I have tons of them; I will try and post some later. Meeka loves water she always try to sit in it or put her paw in her water at the same times she drinks it. She is very protective of her food and knows how to fight. She can also move heavy boards at the bottom of fences to try and escape. Meeks had dark brown and gold hair and she could howl. Sonoma had a pink and black nose and a pink and black tongue. She had white and black fur. She could jump on top of a fence and walk back and forth like a cat. Sonoma gets really sad whenever Meeks is not around. I am taking a shot in the dark. I just want to know if they are taken care of. I would like to see them again. I miss them so much. Any help would be greatly appreciated!
