What’s the next step?

If you are in the process of getting a divorce and need to get your marriage certificate and no place can find it, were you even legally married? How are you supposed to get a divorce if there is no record of you being married? The whole county clerk’s office has no record of the marriage, and he never recalled receiving a marriage license or anything. What does this mean? What would be the next step?
He is in the military though, so if it is found out that he was never married, then he could get in trouble for fraudlent government documents or something and have to pay 8 years worth of wages back to the government for his wife and her two kids…

Default judgment against right name.wrong guy?

I live in California and was contacted at work in 2006 by an investigator that was looking for someone with my same first last name. It seems my father (he has the same name as me) defaulted on money owed through his business and they were suing him. After explaining that I was not the person they were looking for (this took many conversations before they finally believed me) and that unfortunately I was estranged from my father and could not even help them locate him, they finally quit calling.

Now in 2010 I am out looking for a job and this default judgment shows up on my record during a background check! I immediately contacted the company that had sued me and told them I would really like this off my record since they had sued the wrong person. They finally offerred to write me a letter saying that this was not me and that it was a mistake. That’s awesome except the judgment will still stay on my record.

Unfortunately many employers in Southern California where I live use the local court website to access peoples records for free instead of having to pay for a real background search. Frankly the problem is thus far if you pull up my information enough stuff shows up that I don’t need things there that aren’t legit.

I still have a child support failure to pay on my record because the genius people that run this state assumed since I was not married and I had a child with my girlfriend (she is now my wife of 15 years) that I must not be financially supporting them. They filed an unpaid child support on me for $16,000.00 (they finally caught me years after my kid was born and I was living in another state) and froze my bank account and it stayed that way until my wife explained to them that she and the child had been living with me and supported by me the entire time since the baby was born! They stopped messing with my bank account but still the stupid filing against me (even thought it shows there is not an issue anymore) still makes me look like crap to a potential employer.

Now I am possibly going to have another mistake on my record that will call into question my ability to pay bills and my integrity?! If you pull up my court information the following shows up: DIVORCE (from the early 90’s) DUI (from2001) CHILD SUPPORT (mistake!) THIS DEFAULT TO PAY (mistake!) I mean it’s one thing to pull up someones past and see a divorce from when they were a stupid 19 year old kid thinking he was old enough to get married and a DUI (heck I don’t know many men over 25 in Orange County that don’t have a DUI)…but to have 3 red flags show up instead of just one?! That makes a HUGE first impression and frankly I wonder how many employers have not even bothered to call me because of it.

Is there any way to get this new one removed from my file? I have never even tried or discussed removing the child support failure to pay as I assume since it’s the state it will be near impossible to do. It’s disgusting that they ended up on my record in the first place.

The lawyer for the company that sued my father is sounding like if they pull it from my record they have to drop the money owed? I am kind of trying to read between the lines since he did not actually say that, however I kind of was picking up that if they drop it from my record all the way then they are admitting they made a mistake by getting me involved and it’s kind of admitting they made a mistake? Heck maybe they just don’t want to cough up more money to sue my father again? I am definitely no lawyer…however I hope I can get some input on this.

My friends ex husband keeps using her name on property transactions (10 Times) fraudulently, what can she do?

A close friend of mine has been divorced for over 10 years. Apart form the fact that the piece of crap ex-husband has not paid a penny in child support for years (AG dragging their feet) he is and has used her name on multiple real property transactions up to and including October of last year. On all of these records (Harris County, Texas) they are both listed. She has not consented to this nor has she ever signed anything for him. Obviously he is using her name fraudulently.

She is at her wits end, can you please point her in the right direction. Can she call the police? beat cops don’t seem too interested. She lives in constant fear of this man is afraid to confront him.

How to find out if he is married?

My boyfriend and I have been together for a year now and he lives in another state. He lives with his ex-wife and tells me because of the kids and because he is in the army. They live on base but Im not so sure now that he is really divorced. Ive called the county where he lives and they show no record of divorce. He visits me often and stays for a couple weeks at a time because he has classes where I live. Anyway to find out if he is really married or divorced??? Serious answers only please.

Cant find marriage certificate?

My fiance is trying to get a divorce and he got ahold of the county office where his marriage records are and they cant find any record of them. Does this mean he isn’t married? he needs his marriage papers for a divorce…please help!!

before anyone asks…it was a contract marriage in the military and she cheated on him while he was in iraq (i read her written statements and his CO’s statements) and they were divorcing before we got together….
He’s in the military, so wouldn’t they need to see his marriage license. He recalls giving them the papers from the town hall, but no certificate. This either made the divorce a whole lot easier or a whole lot harder…

Child Support Help PLEASE NO RUDE COMMENTS Just need serious answers.Thank You?

In order for you to direct me to the right person for help I would need to explain to you my situation.

I was married to my ex-husband in 2006

He divorced me in 2007 He did an uncontested divorce.

In the divorce it states that he will be giving me child support directly, he was not going to have the courts take it out of his check.

He does have visitations he used to get our 2 boys every other weekend and one month in August.

In the month of August he does not get the child support I continue on getting child support for my children.

In March of 2008 I expressed to their father that I wanted to relocate to Texas. I put in a modification for visitations and hoping that the judge would grant my relocation.

In January 2009 my relocation was granted and I was grateful that the father of my 2 boys also allowed the moved after a whole year in court.

I had told their father I would want the boys to finish school in New York. And he can keep the child support until June. This was a verbal agreement between me and their father that if he would stay with them I would allow him to keep the child support until the month of June.

He was also HAPPY because he stated that it will help him with bills

I finally emailed him the notarized letter stating all the above and I asked him if he received the email he stated NO and I explained to him what I wrote on the notarized letter so that he would be prepared to start giving me the child support again in June. He told me he wasn’t going to give me the child support in June.

Okay in this case how do I go about getting the child support taken out directly from his check, without having to go back to New York?

I’ve called my legal aid that dealt with my relocation case and she hasn’t gotten back to me I’ve called the Tarrant County Courts and they told me in order for me to get help I would need to get my records transferred from NY to TX.

How do I go about doing this??
