What recourse do I have if I’ve discovered my husband was married to someone else at the time of our wedding?

I was searching through the online public records for a county he used to live in and saw he had a judgment awarded to him from a woman bearing his (our) last name two years after our wedding date. We are currently divorcing (but it’s not final yet) and I’m concerned if our marriage is invalidated, my settlement will be too.

Can divorce papers be used to relinquish someone from financial responsibility?

RogerE asked:

My girlfriend got a divorce 2 years ago and here is what her Final Judgment of Dissolution of Marriage says…The joint mortgage shall be the sole responsibility of Husband to pay after the date of the Final Judgment. Husband shall indemnify and hold Wife harmless from any cost, liability or expense arising from the joint mortgage and he shall remove her from the mortgage no later than 2 years after the date of the Final Judgment. Her Final was entered into record on May 30th, 2008. Now, in November of 2009, she is trying to buy a house and the lender says they can’t give her a mortgage because her ex-husband has been behind in his house payments for 4 or 5 months and that this bad credit is being charged NOT ONLY TO her ex’s credit report…BUT TO HERS!!! Now, if she is not responsible, per the Judge endorsed order of the court of Duval County, Florida, for the mortgage and ANY liability of such mortgage, then WHY is this information being placed on HER credit report by Wachovia? AND…are they CORRECT in doing this to her? If they are wrong, shouldn’t there be a way to fix this so she can buy a house and go on with her life? Please, someone out there help me to understand this! Thanks!

What kind of sick game is my husband playing?

Love My Kids asked:

My husband and I have separated. I have expressed my desire to reconcile, however… and I quote it’s more complicated than that… not sure what in the world that means? He’s abandoned me and my children, left us in the home we lived in and closed our joint accounts, so that I am solely responsible for the mortgage, childcare and all utilities. The house is now in foreclosure, he gripped at me saying that I was living in a house I was not making payments on, when he chose to leave, is not paying child support (YET… I’ve filed, waiting on the SLOW AG) and says he will not make any more payments on the mortgage, although he is very upset that his credit is being damaged (mine too as we are joint owners). Here’s the puzzling thing… He only took with him a basket full of clothes, his pickup truck and car, his two motorcycles, leaving me with only one vehicle that has major brake issues and borderline heat. Everything else, the remainder of his clothes, his furniture he brought into the marriage, all his records and computer, all his tools and other garage items are still in our home. Also, ALL the utilities (electric, water, gas and cable) are still in his name. I’ve tried putting them in my name, but he called and placed a restriction on all the services so that all I could do was make payments. I AM NOT going to file for divorce (it is against my beliefs), he says he has but I work for our County office and he hasn’t done a thing. What kind of sick game do you think he’s playing? I KNOW he is not seeing anyone else. Do you think it could be mid-life crisis? He’s 43…

What’s the next step?

Paige A asked:

If you are in the process of getting a divorce and need to get your marriage certificate and no place can find it, were you even legally married? How are you supposed to get a divorce if there is no record of you being married? The whole county clerk’s office has no record of the marriage, and he never recalled receiving a marriage license or anything. What does this mean? What would be the next step?
He is in the military though, so if it is found out that he was never married, then he could get in trouble for fraudlent government documents or something and have to pay 8 years worth of wages back to the government for his wife and her two kids…

sticky situation

Paige A asked:

My fiance is trying to get a divorce and he got ahold of the county office where his marriage records are and they cant find any record of them. Does this mean he isn’t married? he needs his marriage papers for a divorce…please help!!

before anyone asks…it was a contract marriage in the military and she cheated on him while he was in iraq (i read her written statements and his CO’s statements) and they were divorcing before we got together….
He’s in the military, so wouldn’t they need to see his marriage license. He recalls giving them the papers from the town hall, but no certificate. This either made the divorce a whole lot easier or a whole lot harder…

How do I find out If I’m divorced?

NO BODY asked:

I filed for divorce two times and my wife contested the divorce doth times. we have been married for 22 years and separated for 9 years. I just got information form one of our friends, that she got remarried last year. what i want to find out is if we are divorced as far as I know we are still legally married because the court denied the divorce the last time I filed which was in 2005 and the court said i could not file again until she and I go to a court approved marriage counselor. and they determine if the marriage can saved. or not. but she refuses to go. but i have been told you can find divorce and marriage records for free on line. I have searched yahoo and google and all of the ones that say they are free are not free at all. or do i have to go in to the county courts to find out? and does that cost? Thank you
I want to be divorced I have a nice lady I want to marry but can’t, because as far as I know I am Still married and I was told i can’t file again untill we both see the counselor.

Can you change your last name and your records in 6 months? Is it a very time consuming process?

Aycora Bayduv asked:

***I’m asking this question in marriage divorce because I assume many people here have had their last names changed. I am not changing my last name for marriage, but for other reasons.***

I have filed my petition and the necessary paperwork at my county courthouse but my case has yet to be reviewed by a judge. I live in New Jersey and am moving to Minnesota in early June 09, so that is 6 months from now. This is a list I’ve found online that describes what sorts of records I might have to change. Is there anything missing from this list? How do I get my birth certificate changed?

* Department of Motor Vehicles
* Social Security Administration
* credit card agencies
* Internal Revenue Service
* utility companies
* your employer
* the post office
* your mother
* passport
* bank
* stocks/bonds/mutual funds
* retirement plans
* real estate
* professional associations
* the Registrar of Voters
* car registration
* house, car and life insurance
* your will
* other people’s wills
* your doctor
* your lawyer
* powers of attorney
* trusts
* contracts
* frequent flyer programs
* welfare office
* veteran’s administration
* academic institutions (although those still paying back school loans may be tempted not to bother)

Thanks in advance for the answers.

Okay i asked about divorce and custody now this is about how the courts decide….ive read a little but… once again i do not have a lawyer and my husband does. but my husband has more than 15 possesion of marijuana charges on his record/i had a restraining order against him for one year keeping him away from me and my son which he was arrested for i believe 2 times for breaking/ ive called the police numerous times for physical and mental abuse, they could not prove anything, i guess the abuse wasnt bad enough so i could not press charges, but there are records of me calling which probably doesnt matter/ he is currently in jail for his 6th driving under suspension, he only got 60 days./ he is awaiting trial in another county for unpaid fines..

here is the thing- i live in chilli he lves in cinci which is about 2 hours apart, i have a license, college student, part time job, home, stability husband has nothing, no car no license no house he is homeless, no job etc. nothing.

Divorce advice?

Filed under: Marriage Divorce — Tags: , , — admin @ 2:45 am
walkinbyfaith7 asked:

Let me say first that as of now we are both representing ourselves in court. We DO NOT have lawyers and do not plan on getting any until necessary. This is why I’m asking this question on here, so I do not need advice on obtaining a lawyer. We are both in debt big time and agreed to not obtain lawyers for financial reasons
I had my divorce papers served to my ex, they were returned back to me because, I guess, he moved to a different county. I have two questions. First do I HAVE to do anything further with his paper work, or have I done my part in having them served. Two, IF I do have try again, can I just send them to his parents house, since that’s the only other address I know?
Our first mediation meeting is on the 2nd of Nov., so, to be honest, I want him to miss the meeting (this guy’s a piece of crap (criminal records and domestic violence issues) and I’m trying to do anything I can to keep him away from my daughter and me) if it’ll make the case run smoother on my part
ps I had the papers served by a county Sheriff
